QuickAcuity — Privacy Policy and Terms

Summary

We minimize personal information collection. The app stores certain preferences and optional test history locally on your device. We use Firebase services to collect anonymous usage analytics, including optional speech recognition accuracy metrics, input‑mode performance (tap, swipe, or voice), test durations (overall and per eye), and optotype usage patterns to improve performance, manage anonymous authentication for free trial tracking, and validate in‑app purchases. No personally identifiable information is collected or linked to this anonymous data.

Voice input is optional. QuickAcuity remains fully functional using on‑screen buttons or swipe gestures, and we only request microphone access if you choose to enable speech recognition.

Apple, Google, and Firebase may collect information as platform and service providers (e.g., crash logs, diagnostics, app store transactions, analytics). See their privacy policies.

We do not collect audio recordings, speech transcripts, photos, or videos. From time to time, we may update our policies and this document if our data practices change.

Privacy Policy

1. Who We Are

2. What We Collect

We designed QuickAcuity to minimize personal data collection. Specifically:

• On-device app data: the app stores settings and optional test history (e.g., date/time of test, letter size bucket per eye, mode, distance estimate, and any note you add) in local device storage. This data stays on your device unless you back it up with your OS vendor.
• Anonymous usage analytics: we use Firebase Analytics to collect anonymous usage data such as app events (e.g., test started, paywall viewed, purchase initiated). This helps us improve the app. No personally identifiable information is collected.
• Anonymous authentication: we use Firebase Anonymous Authentication to generate a random user ID for managing free trial allowances and purchase entitlements. This ID cannot be used to identify you personally.
• Purchase validation data: when you make an in‑app purchase, we send anonymous data to Firebase Cloud Functions to validate your purchase with Apple or Google. This includes your anonymous install ID, product ID, purchase ID, and platform verification data. We do not receive your payment card details.
• Optional microphone access and speech recognition: QuickAcuity works entirely with tap or swipe input. If you enable speech recognition, we request microphone permission so your device’s operating system can grade spoken responses. Audio is processed by the OS (Apple or Google, depending on your device). We do not receive or retain your audio.
• Input and accuracy analytics (no recordings): to improve every mode, we log limited, anonymous telemetry about letter‑level outcomes such as the expected vs. recognized letter, confidence score, test mode, optotype, input method (voice, tap, or swipe), eye, line ID and position, viewing distance status, and aggregated timing (overall and per eye). This telemetry does not include audio recordings, full speech transcripts, photos, or videos, and is not linked to your identity.
• Camera and depth sensors: When available, we rely on Apple’s TrueDepth or ARKit scene-depth frameworks and Google’s ARCore depth APIs to estimate viewing distance automatically. Depth data is streamed from the front-facing camera, processed on‑device, and not stored or transmitted; no photos or videos are captured or kept. If your device lacks these sensors or you disable camera access, the app falls back to manual distance entry.
• Camera access: Granting camera permission lets us use these depth frameworks for automatic distance calibration. It is optional—the app still works with manual distance entry if you prefer not to allow the camera.
• No third‑party ads or trackers: we do not embed third‑party ad networks or tracking SDKs beyond Firebase services described above.
• No sale or sharing: we do not sell or share personal information as defined by applicable laws (e.g., CCPA/CPRA).

3. Platform Providers and Third‑Party Services

Distribution and certain system services are provided by Apple, Google, and Firebase (a Google service). They may collect data in their capacity as independent controllers. See:

Examples include crash logs, device diagnostics, store receipts, optional speech services provided by the OS vendor, and analytics data processed by Firebase.

4. Legal Bases (GDPR)

We do not process personal data on our servers. For on‑device functionality, we rely on:

• Performance of the app: to provide requested features such as storing preferences and test history locally.
• Consent: for optional permissions like microphone and camera access; you may withdraw consent by disabling the permission in system settings.
• Legitimate interests: to improve recognition accuracy and test reliability using limited, aggregated telemetry (no recordings), and to validate in‑app purchases using anonymous store receipts or tokens.

5. Your Rights

Depending on your region (e.g., EU/UK GDPR, California CCPA/CPRA), you may have rights to access, correct, delete, or restrict processing of your personal data. Since we do not maintain server copies, these rights primarily apply to data controlled by Apple/Google and to data stored on your device.

• On-device data: you can clear the in‑app history in Settings/History (if available) or delete the app to remove local data. If your device backs up app data, removing backups may also be necessary.
• Platform data: exercise your rights directly with Apple or Google regarding store accounts, diagnostics, and purchases.

• Complaint: you may lodge a complaint with your local data protection authority if you believe your rights have been infringed.

6. In‑App Purchases

We offer in‑app purchases for premium features. Payments are processed by Apple's App Store or Google Play. We do not receive your payment card details. We receive anonymous purchase metadata (e.g., a receipt or token, install ID, product ID, purchase ID) to grant entitlements and validate purchases through Firebase Cloud Functions. This data is not linked to personally identifiable information.

7. International Transfers

We do not transfer your data to our servers. Platform providers (Apple/Google) may transfer data per their policies, using appropriate safeguards.

8. Retention

On‑device data persists until you clear it in the app or uninstall the app. We do not retain server‑side copies.

9. Children’s Privacy

QuickAcuity is not intended for children under 13 without supervision. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us to request deletion.

10. Security

We apply reasonable safeguards for local storage and do not transmit your data to our servers. However, no mobile device can be completely secure; keep your device and backups protected.

11. Changes to This Policy

We may update this Privacy Policy to reflect changes in features, regulations, or platform requirements. We will post updates in the app and/or on our website. Continued use after changes means you accept the updated policy.

Terms of Service

1. Acceptance of Terms

By downloading or using QuickAcuity, you agree to these Terms. If you do not agree, do not use the app.

2. Service Description and Health Disclaimer

QuickAcuity provides tools for visual acuity screening and related utilities. It is provided for informational and screening purposes only and is not a medical device and not a substitute for professional diagnosis or treatment. Always seek the advice of a qualified eye‑care professional for medical decisions. To the maximum extent permitted by law, QuickAcuity and its developers shall not be liable for any medical decisions, diagnoses, or treatment outcomes based on the use of this app. This app is not a substitute for professional medical advice. Medical professionals should personally validate test results before use clinically as developers cannot validate tests on all possible devices or platforms.

3. User Obligations

• Use the app responsibly and in accordance with local laws and device guidelines.
• Do not attempt to reverse engineer, modify, or misuse the app.
• Maintain your device’s security and manage permissions appropriately.

4. In‑App Purchases

We may introduce paid features. Purchases are processed by Apple’s App Store or Google Play. Pricing and availability are subject to change. Refunds, if any, are governed by the applicable store’s policies. Taxes may apply.

5. Intellectual Property

The app, including its content, logos, and code, is owned by Dirkes Medical, PLLC or its licensors and protected by applicable laws. These Terms do not grant you any rights to trademarks or content other than limited use of the app as provided.

6. Third‑Party Services

The app may rely on platform services (e.g., optional speech recognition, app distribution, payment processing). We are not responsible for third‑party services, which are subject to their own terms and privacy policies.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. YOUR USE IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Dirkes Medical, PLLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify and hold harmless Dirkes Medical, PLLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the app or violation of these Terms.

10. Termination

We may suspend or terminate access to the app at any time for any reason. You may stop using the app at any time; uninstalling will remove local app data from your device.

11. Governing Law

These Terms are governed by the laws of United States of America, without regard to its conflict of law principles. If you are a consumer, mandatory protections under your local law remain unaffected.

12. Changes to Terms

We may amend these Terms from time to time. Material changes will be posted in the app and/or on our website. Continued use after changes constitutes acceptance of the updated Terms.
